Comprehensive Terms and Conditions - Relevant Content by Blue Pacific Lumber

Welcome to Blue Pacific Lumber. By accessing our website, requesting a quote, or purchasing materials from us, you agree to be bound by the following terms and conditions.

1. SCOPE OF PRODUCTS & SERVICES

  • Blue Pacific Lumber (“the Seller”) specializes in the supply of engineered wood products, including roof trusses, floor joists, and stairs. All sales, quotes, and deliveries are subject to these Terms and Conditions.

2. QUOTES, ESTIMATES, AND QUANTITIES

  • Validity: Quotes are valid for 30 days unless otherwise specified. Due to the volatility of the lumber market, prices are subject to change until a firm Purchase Order is accepted.
  • Quantity Variance: The Buyer acknowledges that material take-offs and quotes are estimates based on standard industry practices. Actual quantities used on-site may vary due to specific framing techniques, contractor preferences, or site-level waste.
  • Extra Material: Any lumber or engineered products ordered in addition to the original quote (including "fill-in" orders or replacements for site-cut errors) will be charged extra at current market rates and invoiced separately.

3. CUSTOMER RESPONSIBILITIES & PLANS

  • Final Plans: The Customer bears the sole responsibility for providing the final, approved set of construction plans (including all architectural and structural engineering sheets).
  • Production Basis: Blue Pacific Lumber will manufacture and supply materials based strictly on the drawings provided. Any discrepancies, errors, or omissions in the plans provided by the Customer are not the responsibility of the Seller.
  • Plan Revisions: Changes made to plans after production has commenced will result in additional design fees and material surcharges.

4. PAYMENT TERMS & LIENS

  • Payment: Net 30 days from the invoice date, unless otherwise agreed in writing.
  • Interest: Overdue accounts are subject to interest at 2% per month (24% per annum).
  • Lien Rights: Per the Prompt Payment and Construction Lien Act (Alberta), the Seller reserves the right to register a lien against the property for unpaid materials.

5. DELIVERY & SITE ACCESS

  • Site Readiness: The Buyer must ensure the site is accessible for heavy equipment. Blue Pacific Lumber is not liable for damage to driveways, curbs, or underground utilities.
  • Delivery Delays: Delivery dates are estimates. The Seller is not liable for "back charges" or liquidated damages resulting from delays caused by weather, equipment failure, or supply chain issues.
  • Risk of Loss: Risk transfers to the Buyer upon delivery to the site, whether or not a representative is present to sign.

6. ENGINEERED PRODUCTS (TRUSSES & JOISTS)

Field Modifications: Any cutting, drilling, or modification of engineered products (truss chords, webs, or joist flanges) without written engineering approval from the Seller voids all warranties and safety certifications.

7. RETURNS & CANCELLATIONS

  • Custom Orders: Trusses, stairs, and cut-to-length joists are Final Sale. No returns or cancellations are accepted once production has begun.
  • Stock Items: Subject to a 25% restocking fee, provided they are returned within 15 days in "as-new" condition.

8. LIMITATION OF LIABILITY

  • Natural Variation: Wood is a natural product; minor warping, checking, or color variation is not a defect.
  • Maximum Liability: The Seller’s total liability for any claim shall not exceed the original purchase price of the specific goods in question. The Seller is not responsible for labor costs to replace material or any indirect/consequential damages.

9. INSPECTION & CLAIMS

  • The Buyer must inspect materials upon delivery. Shortages or damages must be noted on the shipping document immediately.
  • Claims for manufacturing defects must be submitted in writing within 48 hours of delivery and prior to installation.

10. GOVERNING LAW

This agreement is governed by the laws of the Province of Alberta. Any legal proceedings shall be held in the courts of Calgary, Alberta.​

Acceptance:

Payment of a deposit, issuance of a Purchase Order, or request for delivery constitutes full acceptance of these Terms and Conditions by the Customer.
